Trademark battle for brick brand reaches court – Imitator stopped from using brand

Ahmedabad (Gujarat) [India], February 12:  Two local manufacturers got it to a legal battle over use of the brand SB* for bricks. The original adopter and user of the brand served a legal notice through its advocate Nakul Sharedalal. The other party did not respond to the notice but curtailed its illegal use in the market. However, recently the party started using the brand SB+ and therefore the original adopter and user of the brand SB* again served a legal notice. However, as the illegal use didn’t stop, original adopter and user of the brand was constrained to file a trademark suit in the district court at Ahmedabad. Advocates Nakul Sharedalal & Kunjal Pandya appeared and argued for the original adopter and user of the brand and the Hon’ble court was prompt enough to restrain the illegal use of the brand SB+ by issuing an injunction order. Nakul Sharedalal said, “Such orders are the need of the hour to enable the owner of trademarks to enforce their rights freely and effectively.”
